1. Acceptance of Terms

2. Usage Rights

Provided that you:

• Give appropriate credit to recipehearts and the original author.
• Indicate if changes were made.
• Do not use the material for commercial purposes.
• Distribute any derivative works under the same license.

Any content you submit to the Site (including comments, reviews, photos, or recipes) is considered “User‑Generated Content.” By submitting such content you grant recipehearts a worldwide, royalty‑free, perpetual, irrevocable, non‑exclusive license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display the content in any media now known or later developed, for any purpose, including commercial purposes. You also represent and warrant that you have all rights necessary to grant this license and that your content does not infringe any third‑party rights.

4. Disclaimers

The Site and all Site Content are provided on an “as‑is” and “as‑available” basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non‑infringement, or accuracy.

We do not guarantee that the recipes, nutritional information, cooking times, or any other data presented on the Site are complete, current, or error‑free. Users are solely responsible for verifying the suitability of any recipe or cooking technique for their own dietary needs, health conditions, and personal preferences.

We expressly disavow any liability for:

• Injuries, illnesses, or allergic reactions resulting from the preparation or consumption of any recipe.
• Loss of data, loss of profits, or any other consequential, indirect, or special damages arising out of or related to your use of the Site.
• Any interruption, delay, or error in the Site’s operation.

5. Liability Limitations

To the maximum extent permitted by applicable law, recipehearts’ total aggregate liability arising out of or related to these Terms, whether in contract, tort (including negligence), or any other legal theory, shall not exceed the amount you have paid, if any, for access to the Site during the twelve (12) months preceding the claim.

If you have not made any payment to recipehearts, your liability limitation shall be limited to US$100 (one hundred United States dollars).

This limitation applies regardless of whether the alleged liability is based on contract, warranty, tort, strict liability, or any other basis, even if we have been advised of the possibility of such damages.

6. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Site shall be resolved in the following manner:

1. Negotiation: The parties shall first attempt in good faith to resolve the dispute through informal negotiations.
2. Mediation: If negotiation fails within thirty (30) days, either party may request mediation administered by a mutually agreed‑upon mediator. The costs of mediation shall be shared equally.
3. Arbitration: Any dispute not resolved through mediation within sixty (60) days shall be finally settled by binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in English, and the seat of arbitration shall be New York, New York, United States.

Each party shall bear its own attorneys’ fees and costs, except that the prevailing party in arbitration may be awarded reasonable attorneys’ fees as determined by the arbitrator.

Nothing in this section shall prevent either party from seeking provisional remedies (including injunctions) in a court of competent jurisdiction.

7. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict‑of‑law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in the State of New York, and each party hereby consents to the personal jurisdiction and venue of such courts.

8. Modification of Terms

We reserve the right, at our sole discretion, to modify, amend, or replace these Terms at any time. When we make changes, we will post the revised Terms on the Site and update the “Last Updated” date at the top of this page. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.

9. Termination

We may terminate or suspend your access to the Site, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, all licenses granted to you under these Terms shall immediately cease, and you must destroy any downloaded or printed copies of Site Content.
